Judge Awards $72M in Male Sexual Assault Case

On June 24th, Brent Coon & Associates won a $72 million default judgement for their client who was sexually assaulted at a Men’s Health clinic in Texas.  The client, referred to by his initials “P. H.”, went to Men’s Health in Houston, Texas to receive treatment for erectile disfunction.  That treatment was to consist of “focused compression therapy or low-intensity shockwave therapy, a type of ED therapy that utilizes acoustical, pulsating sound waves to rebuild, strengthen and open up the blood vessels where the dysfunction is occurring.”  However, during the treatment and after Men’s Health employee Randolph Colter (“Coulter”) made sexually suggestive comments to P. H. and Coulter sexually assaulted P.H. by inserting his fingers and penis into P. H.’s rectum. Brent Coon & Associates attorney Robert Schwartz obtained a $72,468,000 judgment against Metro Men’s Health, LLC,  Metro Men’s Health Maryland, LLC,  and Metro Men’s Health, LLC (Collectively referred to as “Men’s Health”) for a sexual assault victim in a trial to the Court on June 24, 2024.

BCA filed a lawsuit for P. H., and after a trial, the Court issued the judgment.  The judgment includes actual damages for P.H.’s physical and mental pain and suffering, and punitive damages because Coulter’s conduct was so egregious and outrageous. The Court was presented with evidence that Coulter had sexually assaulted another individual at Men’s Health in the same way just months prior.

The Court found that Men’s Health created an extreme degree of risk to P. H. considering Men’s Health knew of Coulter’s prior sexual assault and did nothing to prevent Coulter from assaulting P. H. or anyone else.  Men’s Health kept Coulter employed and allowed Coulter to continue to treat their patients.  This, the Court found, showed a conscious indifference to P. H.’s safety and welfare.
